Reports of Autonomous Communities and Local Entities in Immigration Proceedings

In this section you can find information on the reports issued by other administrations within the procedures of residence, residence and work authorizations and family reunification.

The Regulation of Organic Law 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, approved by Royal Decree 557/2011, of 20 April, establishes the possibility of submitting four types of reports, which are the competence of the Autonomous Communities, although in two of them (rooting and adequate housing) they can establish these that are issued by the Local Entities (click on each of them for more detailed information):

  • It is a report issued by an Autonomous Community, at the request of a foreign citizen who wishes to:

    • Renew your non-profit temporary residence permit
    • Renew your authorization of temporary residence by family reunification.
    • Renew your authorization of temporary residence and work for yourself or others.

    This report does not have to be submitted compulsorily, but it can be invoked by the foreigner in case of not proving compliance with any of the requirements foreseen for the renewal of the authorization and will be taken into account as information to be assessed by the Aliens Office.

    This report is requested in the Autonomous Community of your place of residence.

    The minimum content of the report shall be the certification, where appropriate, of the alien’s active participation in training activities aimed at understanding and respecting the constitutional values of Spain, the statutory values of the Autonomous Community in which he or she resides, the values of the European Union, human rights, public freedoms, democracy, tolerance and equality between women and men, as well as the learning of the official languages of the place of residence. In this sense, the certification will make express mention of the training time dedicated to the areas indicated.

  • One of the requirements of social rooting is to have family ties with other resident foreigners or, failing that, to submit a rooting report attesting to their social integration.

    That is, one of them must be accredited so that if you have family ties with other resident foreigners, referring to spouses or registered partnerships, ascendants and descendants in first degree and directly online, it will not be necessary to request the report.

    Both documents will be required, however, only when the report exempts the foreigner from the need for an employment contract provided that he/she proves that he/she has sufficient means of living.

    In a report it is issued by the Autonomous Community in which it has its habitual domicile or by the City of its place of residence in case it has been established by the Autonomous Community. The deadline for the issuance of the report is 30 days from the date of application.

    In the event that the report has not been issued on time, a circumstance that must be duly accredited by the interested party, this requirement may be justified by any means of proof admitted in law, including, at least, the minimum data of the report.

    Among other factors of rooting, the report should include the time of stay of the interested party in his habitual domicile, in which he must be registered, the economic means with which he counts, the links with family members residing in Spain and the integration efforts through the monitoring of socio-labor and cultural insertion programs.

    A guideline model of a rooting report is attached hereto, containing the minimum content to be included in this type of report, in case it may be of use to the competent administrations.

  • This report must be submitted by foreigners who wish to apply for an initial authorization of temporary residence by family reunification or upon renewal, only if they have changed their domicile.

    These procedures require the applicant to prove, among other things, that he/she has adequate housing to meet his/her needs and those of his/her family. To do this, you must request a report from the Autonomous Community of the place in which you reside or the City of your habitual residence, if established by the Autonomous Community.

    The Autonomous Community or the City Council must issue the report and notify the interested party within a maximum period of thirty days from being requested.

    In case the report has not been issued within that period, the provision of adequate housing may be accredited by any other means of proof admitted in law, accompanied by the copy of the request for the report.

    The report or the documentation submitted in its replacement must refer, at least, to the following points:

    • Title that qualifies for the occupation of the house (housing on property, rental contract, etc.)
    • Number of rooms, use to which each of the units of the house is destined, number of people who inhabit it and conditions of habitability and equipment.

  • The report on the schooling of minors can be presented by foreigners who have in Spain minors in charge of compulsory schooling age (from 6 to 16 years) when they request:

    • The renewal of a residence permit
    • A long-term residence
    • A change from a situation of residence due to exceptional circumstances to a situation of residence or residence and work or to a residence with the exception of the work permit.

    The report must be requested from the competent authority in the Autonomous Community where the child in charge is enrolled in school.
