Sheet 6 - Initial Authorization of Non-Profit Temporary Residence

TYPE OF AUTHORISATION 

It is an authorization requested by foreign persons and their relatives from their country of origin that authorizes to reside in Spain without performing work or professional activities.

BASIC REGULATIONS 

  • Organic Law 4/2000 of 11 January on the rights and freedoms of foreigners in Spain and their social integration (articles 30 bis and 31).
  • Royal Decree 1155/2024, of 19 November, approving the Regulations of Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration (articles 60 to 63).  

REQUIREMENTS 

  • Not to be a citizen of a State of the European Union, of the European Economic Area or of Switzerland, or a family member of citizens of these countries to which the regime of citizen of the Union applies.
  • Not to be found irregularly in Spanish territory.
  • Lack of criminal record in Spain and in the countries where he has resided for the last five years, for crimes existing in the Spanish legislation.
  •  Not to appear as rejectable in the territorial space of countries with which Spain has signed an agreement in this regard.
  • Do not pose a threat to public order, safety or public health. 
  • Have the economic means necessary to cover the costs of maintenance and residence and, where appropriate, those of his family, during the period of time for which he wishes to reside in Spain, and without the need to carry out any work or professional activity, according to the following amounts:  
  • For its sustenance, monthly, 400% of the IPREM.
  • For the support of each of their relatives, monthly, 100% of the IPREM.
  • Have a public or private health insurance arranged with an insurance company authorized to operate in Spain.  
  • Not to suffer from any of the diseases that may have serious public health repercussions in accordance with the International Health Regulations of 2005.  
  • Not to be found, where appropriate, within the term of commitment of no return to Spain that the foreign person has assumed when voluntarily returning to his country of origin.  
  • Pay the fee corresponding to the processing of the procedure.  

EXIGIBLE DOCUMENTATION 

Note: in general, copies of the documents must be provided and the originals must be displayed at the time of submitting the application. 

  • Full copy of the passport or travel title, recognized as valid in Spain, with a minimum validity of one year.
  • Criminal record certificate issued by the authorities of the country of origin or of the country or countries in which you have resided during the last five years prior to entry into Spain.
  • Documentación acreditativa de disponer de medios económicos para el período que se solicita.  

It can be accredited by any means of proof, including the provision of property titles, certified checks or credit cards accompanied by a bank certification that accredits the amount available as credit on the card.

If the means come from actions or participations in Spanish, mixed or foreign companies based in Spain, it will be accredited by certification of the same that the applicant does not exercise any labor activity in them, also accompanying an affidavit of the foreign person in this regard.

  • Documentation accrediting the availability of medical insurance.
  • Medical certificate.  

Important note: when documents are provided from other countries they must be translated into Spanish or co-official language of the territory where the application is submitted by a sworn translator.

On the other hand, any foreign public document must be previously legalized by the Consular Office of Spain with jurisdiction in the country in which such document has been issued or, where appropriate, by the Ministry of Foreign Affairs, European Union and Cooperation, except in the case where such document has been apostilled by the competent authority of the issuing country in accordance with the Hague Convention of 5 October 1961 and unless such document is exempt from legalization under the International Convention.

PROCEDURE 

  • Subject entitled to submit the application: The foreign person personally, or his legal representative or person who provides support in the event of being a minor or a person with a disability.

  • Place of presentation:   
  • In person, at the Spanish Consular Office in whose demarcation the foreign person resides (or, where appropriate, before the external service provider or before another embassy/consulate designated by the competent Ministry of Foreign Affairs)

  • Corresponding fee: it will accrue at the time of submission of the application, and must be paid within ten working days:  
  • Model 790 code 052, section 2.1.1. “Initial authorization of non-profit temporary residence”: to be paid by the foreign person.

  • Deadline for the resolution of the request: The competent body will decide on the authorization of residence within a maximum period of one month from the receipt of the communication from the consular office. Once this period has elapsed without a response, it will be understood that the request has been rejected.
  • (When it has not been possible to notify the resolution it will be announced in the Single Edictal Board (TEU). If you have opted for electronic notification or are legally obliged to use that medium, the resolution will be notified by publication in the electronic headquarters. If the resolution is not accessed within ten calendar days of its publication, it will be given as notified). 
  • In the case of granting the residence visa, the foreign person has one month from the notification to collect it personally. If you do not do so, it will be understood that you have waived the visa granted, and the procedure will be filed.
  • Once the visa has been collected, the applicant must enter Spain within the term of validity of the visa, which in no case will be longer than three months.
  • The initial authorization of temporary residence will have the duration of one year and the validity will begin on the date on which the entry into Spain is made.
  • Within one month of entry into Spain, the foreign person must personally request the identity card of a foreigner, at the competent Police Station or police services of their place of residence.
